Under the new rules imposed by The Texas Mold Assessment and Remediation Rules (TMARR) (25 TAC §§295.301-295.338), a property must be inspected by a licensed Mold Assessment Consultant who will perform a visual inspection and take samples for analysis by a state licensed laboratory.

IF a mold-related hazard is identified:

  1. The Mold Assessment Consultant will prepare a Mold Remediation Protocol that will executed by a licensed Mold Remediation Company.
  2. The Mold Remediation Company will follow the procedures outlined in the Protocol to remove and correct the problems identified by the Consultant.
  3. The property will be re-inspected by the Mold Assessment Consultant to insure that the mold problem has been corrected.
  4. The remediation company then issues a Certificate of Mold Damage Remediation which will be signed by the Mold Assessment Consultant. This document may be presented to insurance companies, mortgage companies and potential buyers of the property. It should be carefully protected as part of the records pertaining to the property.

During the assessment and remmeditation process, the property owner will be presented with a varety of documents. Some of these documents are required by law to be presented to the property owner.
